Pro Bono Week - 2013

Next week is Pro Bono WeekNevada Legal Services will be holding an Ask A Lawyer/Forms Clinic at the Law Library on Thursday, October 24 from 10 a.m. to 4 p.m. 

Additionally, Law Library staff will be at the legal aid fair held by Volunteer Attorneys for Northern Nevada on Saturday, November 2 from 9 a.m. to 4 p.m. in the Sierra Room at the Carson City Community Center.

If you cannot make it to Carson City on either of the above dates, check out the list of events posted on the State Bar of Nevada's website

Nevada Revised Statutes 2013 Reprint is HERE!

The Law Library has received the NRS 2013 Reprint (if you want to order one for yourself, contact LCB Publications).  The copies in Reference and Ready Reference have been filed and the set located in the Southwest corner of the library by Room 104/105 should be completed by October 24th.  The 2013 Reprint has not yet been posted on the LCB's website, but we hear it will be uploaded in the next few weeks. 

ETA - the Law Library archives one copy of each NRS reprint, so if you need a NRS section from some prior year, please contact the Reference Desk (775-684-1640 or reference@nvcourts.nv.gov ).

Is the NRS Updated Yet?

No, LCB staff is hard at work codifing acts passed by the 2013 Legislature.  We do not expect to receive the 2013 Nevada Revised Statutes until November or December.  Supplements to Lexis' Michie's Nevada Revised Statutes Annotated and West's Nevada Revised Statutes Annotated should be available shortly thereafter.

In the meantime, update the 2011 NRS Reprint using the tables and indices available on the LCB's 2013 Bill Information page. 

If you prefer print, you can use the tables in the 2013 Statutes of Nevada advance sheets (REF KFN625 .A2 2013 and READY REF KFN625 .A2 2013). The bound 2013 Statutes of Nevada has not yet been published, and will be added to the collection as soon as it is available.

A word of caution:  don't think you can avoid updating by using Westlaw and Lexis.  Currently the NRS available on Lexis and Westlaw is the 2011 version, though there should be red Shepard's and KeyCite flags for those sections which have been amended.  Titles and chapters, however, are trickier and it is good practice to review the tables linked above.

Oh, and when you are done with the 2013 session, you can do it again with the tables for the 27th Special Session.

tl;dr:  no, use these tables to update the 2011 NRS.

ABA Journal Article: Are digitization and budget cuts compromising history?

There's an interesting piece on efforts to digitize and authenticate legal materials - including the Uniform Electronic Legal Materials Act - in this month's issue of the ABA Journal
While librarians see an enormous upside in increasing public access to material that once was buried in less romantic storage facilities, they are concerned about the accuracy and preservation of legal information that is “born digital,” according to Michelle Wu, director of the Georgetown Law Library.
Wu says the concerns facing modern law libraries are incredibly complex, noting that it’s difficult to keep up with the sheer volume of legal information being generated. She worries about legal information being kept behind subscription walls, and wants to feel confident that libraries have the capacity to capture new information and ensure access to it in perpetuity.
“So much is now represented by what’s online,” Wu says. “The concern is that materials that are not online will disappear from history and won’t be part of our societal knowledge.”

Treatise Spotlight: Judicial Puzzles, Gathered from the State Trials by John Paget

The following is a guest post by our cataloger, Ann.

While barcoding a section of books, I came across this little gem.  It is not in the best of condition so I am moving it to the rare book room where it will have an easier life.  It is indeed small, measuring 7" by 4 1/2" and has been repaired using tape that would make an archivist cringe.  It has multiple ink stamps and came from the State Library when we received the legal collection.

May Self-Help Clinic at the Supreme Court Library

Nevada Legal Services will hold its monthly Self-Help Forms Completion clinic for people who are filing without legal representation.  The clinic will be at the Supreme Court Library on Thursday, May 9, from 1:30-3 p.m. Assistance and legal education will be provided to complete forms and a Notary Public will be available to notarize your documents at no cost. 

The previously-scheduled education clinic has been cancelled.

April Self-Help Clinics at the Nevada Supreme Court Library

4/9 ETA:  Good news - this previously-cancelled clinic will be held at the Supreme Court Law Library on 4/11 after all.

Nevada Legal Services will be holding two clinics at the Supreme Court Library on Thursday, April 11. The monthly Self-Help Forms Completion Clinic will run from 1:30-3 p.m. and the Education Clinic (Bankruptcy Education) will be held from 3:30-5 p.m. While the forms completion clinics are drop in, you must register for the education classes by calling 775-284-3491 x214.

Civil Practice Act of 1911, Crimes and Punishments Act of 1911 and Criminal Practice Act of 1911

The 1911 Legislature passed three acts on civil procedure, crime and criminal practice which legal researchers still occasionally reference.   If you find yourself confronted with 1911 CPA, 1911 C&P or 1911 Cr. Prac. and want to know why you can't find a citation to the Statutes of Nevada or a copy of the act, it is because they were not published.  Here is the explanation from the Legislative Counsel's Preface to the 2011 Nevada Revised Statutes:
In the case of the Civil Practice Act, Criminal Practice Act and Crimes and Punishments Act of 1911, which were omitted from Statutes of Nevada 1911 as authorized by chapter 84, Statutes of Nevada 1911, the reviser has employed the following abbreviations in the legislative history:

1040 Instructions Have Arrived

Thanks to the staff at the Nevada State Library and Archives, we now have the 2012 1040 Instructions available for the public.  (NLSA obtains the forms and makes them available at the Supreme Court Law Library as a service to our patrons.)

We do not have all forms obtained by the NSLA, but do have the following:
1040, 1040 A, 1040 EZ, 1040-V, 1040 X, 1040 Schedules A, B, C, C-EZ, D, E, EIC, F, R and SE, 2106, 2441, 3903, 4562, 4868 (First Extension), 5695, 8283, 8812, 8822, 8829, 8863, and 8949.  We have the instructions for forms 1040, 1040 A, 1040 EZ, 1040 X, 1040 Schedule R, 2106, 2441, 4562, 8283, 8812, 8829 and 8863. 
If you need a W-2, W-3, W-4, 1096, 1098, 1099-DIV, 1099-G, 1099-INT, 1099-MISC, 1099-OID or 1099-R, they are available at the State Library.  Also, you can obtain copies of most forms and instructions from the IRS website.

NSLA also has some California State Tax forms:  CA 540, 540 NR and 540 2EZ.

How to Locate Free Case Law on the Internet

There's a good post on the Law Librarians of Congress In Custodia Legis blog this morning titled How to Locate Free Case Law on the Internet:
One of the defining features of the common law system is the emphasis placed on the precedential value of case law. Until recently, case law has not been widely available on the Internet, leaving researchers with no choice but to seek out print reporters and commercial electronic databases to locate cases of interest. This situation has started to change, however, and now researchers have several free, online databases at their disposal. These resources do not replace the use of commercial print and electronic resources, since they are often limited in coverage, do not provide a digest, and do not contain a quick and effective citator, but researchers’ use of free online materials as a starting point can save them time and money. 
The Nevada Supreme Court posts its advance opinions online for a limited period of time (as of today they go back one year to February 2012).  Earlier opinions are available on Findlaw (back to January 1997).

UPDATED 3/12/13:  THIS CLINIC HAS BEEN CANCELLED DUE TO FAMILY EMERGENCY

Nevada Legal Services will be holding two clinics at the Supreme Court Library on Thursday, March 14. The monthly Self-Help Forms Completion Clinic will run from 1:30-3 p.m. and the Education Clinic (Sealing Criminal Records) will be held from 3:30-5 p.m.  While the forms completion clinics are drop in, you must register for the education classes by calling 775-284-3491 x214. 

The schedule of educational clinics for the rest of the year is as follows:

May 9, 2013 - Family Law Education - Adoption
June 13, 2013 - Guardianship Education

Tax Forms Are Here

Thanks to the Nevada State Library and Archives, the IRS forms for 2012 are now available at the Law Library.  We are open Monday through Friday from 8 a.m. to 5 p.m.  Enter through the Stewart Street side of the building. 

2/7/13 ETA:  We do not yet have 1040 and 1040A instructions.  We hope to receive them by the 19th, but patrons may contact the library (775-684-1640) to verify they are in.

Free Legal Clinics at the Nevada Supreme Court Library

Nevada Legal Services has announced its 2013 Legal Clinic Schedule for the Supreme Court Library.  The monthly Self-Help Forms Completion Clinic will now be held on the second Thursday of the month.
