Filing an Answer in Justice Court

The First Judicial District Court Clerk's Office has posted Instructions for Preparing, Filing, Serving an Answer in Justice Court on its page of Justice Court forms. (There are sample District Court forms as well, although no Answer as of this posting.)

NOTE: This document has been prepared as a courtesy and to assist you with completing your Answer. It is not to be construed as providing legal advice or representation on how to prepare your case or defense.
If you’ve been served with a Summons and complaint in the Justice Court and have been named as a defendant in the case, you have the option of preparing, filing, and serving an Answer in response to the complaint. An Answer is your formal reply to the court and the plaintiff’s attorney (or the plaintiff if he doesn’t have an attorney.) You must reply to each paragraph/allegation in the complaint by admitting it, denying it, or denying it because you don’t have enough knowledge or information to be able to admit it. You only have 20 days from the day you were served with the Summons and complaint to file and serve your Answer. If you don’t file an Answer in the court and serve a copy to the plaintiff’s attorney (or the plaintiff, if he’s unrepresented) within 20 days of the day you were served, then the plaintiff may obtain a default judgment against you.
WARNING: The filing of an Answer affects your legal rights. If you file an Answer, you have agreed that the court in which you file your Answer has good and proper jurisdiction over you to decide your case.

Rule Amendments

Don't forget there is a lag between when a rule is adopted/amended/repealed and when it makes it into the print NRS. There is a new sortable table available on the Supreme Court's website which has links to the Administrative Docket and orders amending court rules. The table includes the ADKT number, rules affected, links to both the ADKT and order, a short description of the amendment and effective date and each column is sortable.

Attorneys practicing before the Nevada Supreme Court might be interested in the 11/4/11 order on ADKT 467 amending NRAP 3C, 3E, 28.1, 28.2, 32, 40, and 40A and Associated Forms - "Concerns format and length of briefs, fast track statements and responses, and petitions for rehearing and reconsideration" which is effective 1/3/12.

For IE, go to Tools | Pop-up Blocker | Pop-up Blocker Settings and type the following into the Address of Website to Allow box:

While working on another matter, I recently discovered an interesting document on the Legislative Counsel Bureau Research Division's Publications/Fact Sheets page: Fact Sheet on Residency Requirements in Nevada. It includes links to relevant NRS citations. For example, if one wondered how long s/he needed to live in Nevada to be eligible to vote:

Persons are eligible to vote if, before an election, they have continuously resided in the State and the county for 30 days and in the precinct for 10 days (NRS 293.485).

New (Fiscal) Year, New Presumptive Maximum Amounts of Child Support

Back in October of 2010 we blogged about Presumptive Maximum Amounts (PMA) of Child Support. PMAs are adjusted every year effective July 1, so there is a new document available on the Court's website with the new amounts.

The presumptive maximum amounts for July 1, 2011-June 30, 2012 may be found on the Supreme Court's website under Documents and Forms | Self-Help/Pro Se | Family Division Forms. PMAs back to July 1, 2003 are also available from the court's website.

Prime Interest Rates - Update

Divorced in Nevada

Now known as a location for fabulous weddings, in the 20th century Nevada was a haven for the rich and famous seeking "quickie" divorces although not everyone seeking a Nevada divorce was rich or famous. Are you wondering if your long-lost spouse divorced you in Nevada? Divorce records are located at the county level, but you may contact the state Department of Vital Records (775-684-4242, vitalrecords@health.nv.gov) to determine in which county a divorce was granted. There is a request form which includes county recorder contact information.

Marriage and Divorce Records

Please note that marriage and divorce records are held at the county level. For certified copies of marriage certificates, you must write to the County Recorder in the county where the license was purchased. For divorce records, you must write to the County Clerk in the county where the divorce was granted. Our Office can search for and verify events occurring after 1968 if you submit a request containing the full name(s) of the person whose record you are searching for, the approximate date of the event and the city where you believe the event occurred. The fee for verification of a record is $10.00 for each name searched.

2011 Nevada Jury Instructions -- Civil

The State Bar of Nevada recently published the Nevada Jury Instructions -- Civil, a revision of model civil jury instructions. The 2011 edition is a three-ring binder with an included CD-ROM. Topics include negligence, personal injury, intentional torts, products liability, premises liability, medical malpractice, fraud, punitive damages, contracts, contractual relationships, commercial torts, employment, and construction defects. There is also an appendix with forms. More info on this publication is available on the bar's website.

The previous version was the Nevada Pattern Jury Instructions published by Michie (now LexisNexis) in 1986.

First Judicial District Court Forms

Nevada Reports online

The Clerk's Office recently announced it has posted the preliminary print of Nevada Reports pages to the court's website. The pages will be updated in batches as book pages are released and will posted to the website under a tab labeled "Decisions" on the court's home page (right-hand side under "Supreme Court Cases)."

Nevada Legislature Open Poll

Workshops for Self-represented Litigants

Nevada Legal Services continues its informative series of free workshops and assistance from 1-3 p.m. and 3:30-5:30 p.m. Thursday in the auditorium. The first session provides help for those litigants who are representing themselves and need clarification filling out legal forms. The later workshop addresses foreclosures, a topic affecting many Nevadans. The first series was very well attended, so registration is necessary. Call 775-284-3491 ext. 230 to secure both a space and the handout materials.

Note this announcement was in the 2/20/11 edition of the Appeal, so those interested should call Nevada Legal Services to confirm the next scheduled workshop.

Supreme Court Docket Online

The Court's case management system is now available via a public portal.

All Supreme Court case documents, with rare exceptions, can now be accessed through the court’s website, announced Tracie Lindeman, Clerk of the Court. Nevada is one of only a few appellate courts nationally to offer such access to case records at no cost.

On the right side of the home page of the Supreme Court website (www.nevadajudiciary.us) is a box labeled “Supreme Court Cases” with a subheading of “Case Search.” After clicking on the “Case Search” link, a viewer can access a file by typing in the name of a party or the case number.

Supreme Court Rule 42 allows for the practice of attorneys not admitted in Nevada. The State Bar of Nevada has established a procedure in accordance with SCR 42 and has posted a packet on its website (links are halfway down the right-hand column) containing the application form (.pdf) (.doc).

Pro Bono Week

National Pro Bono week is October 24-30, 2010. The State Bar of Nevada has event details on its Access to Justice Commission page.

VARN is sponsoring free legal aid fairs in northern Nevada: in Carson City on Saturday, October 23; in Fallon on Wednesday, October 27; and in Winnemucca on Thursday, October 28. Details are available on VARN's website.

For folks in Reno, Nevada Legal Services, Washoe Legal Services and the Washoe County Senior Law Project are jointly sponsoring a legal education fair at the Meadowood Mall on Tuesday, October 26.

Lastly, for folks in Clark County, there are a number of events including the Family Law Self-Help Center Computer Lab grand opening on Monday, October 25; several ask-a-lawyer sessions on Tuesday; and "survivor island" for seniors on Thursday.

Durable Power of Attorney for Health Care Decisions

Recently a patron asked for a sample living will form. It took me a while to find one (PDF), so I am posting a link here for others who are interested.

The Nevada Center for Ethics and Health Policy at the University of Nevada Reno hosts NVLivingWill.com. The Forms/Downloads section includes a form and planning documents (in English, Spanish and a translation prepared by the Filipino Outreach Committee) as well as a link to the Nevada Secretary of State's Living Will Lockbox. For those of you who like doing things online, NVLivingWill.com also includes a free (registration required) online durable power of attorney for health care generator.

We often field queries about Service of Process (NRCP Rule 4) at the reference desk. The folks at the First Judicial District Court in Carson City have developed a nice handout called Service of Documents that addresses many of those questions.

Nevada Court Rules

Nevada court rules are available on Nevada Legislature's website. The legislature's version conforms to the print edition of the NRS, which as of today's writing is the 2007 Reprint with 2008 Revision 2 replacement pages (notated (2008) R1 in the footer of each replacement page).

Court rules are not searchable, but they are indexed in the Nevada Revised Statutes. The index is quite voluminous, but here's a trick to navigate it. To find the Nevada Rules of Civil Procedure, select a section of the alphabet, such as "C" for civil procedure and when the page loads, click on Edit Find, type a text string such as CIVIL PROCEDURE in all capital letters in the box, and click on the "Match Case" check box (in Firefox) or click on Edit Find and then click on the "Options" drop down list (in Internet Explorer) to jump to that index term. In this case, the Rules of Civil Procedure are not on the C index page, but there is a "see" entry with a link to the Nevada Rules of Civil Procedure.

CIVIL PROCEDURE, NEVADA RULES OF (See NEVADA RULES OF CIVIL PROCEDURE)

Since the Court Rules on the legislature's page are only as current as the print NRS, researchers are advised to check the Court's website for administrative orders amending the rules. In the NRCP example, there four orders (ADKTs 276 order dated 2/6/09; 426 order dated 2/6/09; 405 order dated 4/29/09 and 388 order dated 11/17/09) which have not yet been incorporated in the legislature's online version.

Motion to Show Cause

We've had an upswing in requests for sample motions to show cause. The Washoe County Family Self-Help Center has a form (M-8) but it only available from the Self-Help Center (and is not on the website). Fortunately, the Clark County Law Family Self-Help Center also has a sample motion (Packet 110) available on its Custody page, under "Custody Motion Packets."

Changes coming to Westlaw and Lexis

West and Lexis have been revamping their services. West debuts WestlawNext on February 1st and New Lexis will be released later this year.

Attorney and legal blogger Robert Ambrogi had the opportunity to use WestlawNext and says:

This is no mere cosmetic redesign. WestlawNext completely changes the search interface and the search engine behind it. In fact, the change is so dramatic that West has given its new search engine its own name: WestSearch. This new search engine does not just look at the terms you enter, a West executive said. Rather, it tries to identify the issue of law based on the terms you searched.

Less is known at this point about New Lexis. The February ABA Journal has an article on both Westlaw and Lexis and includes the following regarding New Lexis:

“Our new search engine is radically different,” says Marty Kilmer, vice president for new product strategy at LexisNexis. “Under the old system you had to know what you wanted to search. You had to drill down to find the right databases.”
....
An early preview of the New Lexis opens with a simple query box. Boolean search terms—like “Roe and Wade” or “Scalia or Roberts”—are a thing of the past. Users can type a simple query with natural language, a la Google or Yahoo. Queries can be filtered by jurisdiction, type of content or other restrictions. The search engine, like Google, has artificial intelligence that will help pull more relevant results.

Nevada Rental Foreclosure

If you are a renter who's dwelling unit is being foreclosed upon, the Legal Aid Center of Southern Nevada has a useful summary of Nevada law on rental foreclosures. The summary includes sample letters to the new owners, step-by-step lists of what to do if you are served with a summons and complaint and information for Section 8 tenants.

Some months ago Westlaw began adding unpublished orders to the Nevada Cases database. These orders are not citable in Nevada courts per SCR 123.

If you are searching NV-CS and wish only to retrieve published opinions, use the following search string to exclude unpublished orders from your result:

search terms AND NOT ci(unpublished)

Be sure to use the "and not" operator at the end of your search. Note, this only works when using Terms & Connectors.

Wake-Up Call on Slipshod Search Terms

Supreme Court Unveils New Website and Domain

The Supreme Court unveiled its new domain and website this morning. A feature of the new website is summaries of the cases before the court. The court is also streaming oral arguments and archiving audio files of prior oral arguments (though there's a bit of a lag before they are posted).

Fla. Bar Association Sued Over Ban on Client Testimonials

Public Citizen has sued the State Bar of Florida on behalf of attorney Joel Rothman challenging the constitutionality of its ban on client testimonials in attorney advertising.

The case stems from Rothman's use of the online lawyer directory Avvo, which not only lists attorneys but also ranks them on a scale of one to 10 and gives clients an opportunity to review attorneys.

Rules on attorney advertising in Nevada can be found at NRS 7.045, RPC 7.1-RPC 7.4.

Petition for Judicial Review

The Clark County Civil Law Resource Center has developed instructions and sample forms to petition for judicial review. You can find the forms on the Eighth Judicial District Court Probate website under the section "Petitions and Order Packets."

Updated 4/9/10: The Petition for Judical Review has been moved to the Civil/Criminal/Probate Forms Library section of the Clark County Courts website. The forms are listed alphabetically and you will need to scroll about two-thirds of the way down the page to find the petition.
